El Tribunal de Justicia de la Unión Europea (TWENTY), en su sentencia de 5 June 2018, relativa al caso Montero Mateos (C-677/16) sobre la indemnización por finalización de contrato de interinidad da un giro en la doctrina sobre el derecho de los trabajadores temporales a una indemnización equiparada a la de los fijos con motivo de su llegada a término al rectificar su criterio y entender ahora que no hay discriminación en la legislación laboral.

Al aceptar las conclusiones principales de la Sra. Kokott (Abogado General), el TJUE considera que no son situaciones comparables y que, por lo tanto, no existe discriminación entre los contratos temporales y los contratos indefinidos en términos indemnizatorios.
