La justicia europea llama la atención de nuevo a las autoridades españolas para que protejan a sus ciudadanos de los ruidos nocturnos de bares, pubs y discotecas. En su sentencia, publicada el pasado martes 16 de enero, the European Court of Human Rights (ECHR) ha estimado el recurso interpuesto por un vecino octogenario de Valencia y obliga a las autoridades españolas a indemnizarle con más de 13.000 euros.

Los magistrados del tribunal de Estrasburgo han coincidido por unanimidad en que se ha producido una violación del derecho a la vida privada y familiar del demandante, amparado en el artículo 8 de la Convención Europea de Derechos Humanos.

Antes de llegar al TEDH, el caso fue revisado por el Tribunal Constitucional. Éste examinó el informe médico realizado al hombre, que diagnosticaba un trastorno del sueño a raíz del exceso de ruido que derivaba en un síndrome depresivo y de ansiedad, disminución de la habilidad intelectual e irritabilidad entre otras cosas.
