La Sección Segunda de la Audiencia Provincial de Alicante ha condenado a una multa de 1.440 euros a unos padres por permitir que sus tres hijos faltaran a clase durante varios meses y por no escolarizar a uno de ellos hasta que cumplió los ocho años. La Sala, que confirma así una sentencia dictada por el Juzgado de lo Penal número 4 de Alicante, les considera autores de un delito de abandono de familia y aprecia la atenuante de dilaciones indebidas.

En su resolución, la Sala considera “muy grave” la conducta de los condenados, que no acudieron al juicio y no dieron ninguna explicación sobre la situación. Según detalla la Audiencia, la desatención “no tiene que ser solo económica, sino que puede afectar a otros ámbitos precisos para el desarrollo integral del menor”. Añade que “fomentar o no poner coto al absentismo escolar reiterado, supone un incumplimiento patente de los deberes asistenciales, que puede truncar las posibilidades que al menor le ofrece el aprovechamiento de la vida en el ámbito educativo “.
